Terms of service.

The rules that govern registration, bidding, deposits, and settlement on this platform.

1. Acceptance and eligibility

By creating an account or placing a bid, you accept these terms in full. You must be at least eighteen years old and legally able to enter into a binding contract in your jurisdiction.

2. Account registration and verification

Accounts require a verified email address and, for certain bid tiers, identity documentation reviewed by our onboarding desk. The information you provide must be accurate. We may suspend an account if submitted documentation cannot be verified.

You are responsible for maintaining the confidentiality of your credentials and for any activity under your account until you notify us of compromise.

3. Bidding rules and binding offers

Every bid placed on this platform is a binding offer to purchase at the bid amount plus the applicable buyer’s premium. Bids cannot be retracted once accepted by the system. The highest bid at the scheduled close of an auction wins the lot, subject to any reserve.

4. Ta2meen deposit, escrow, and release

A 10% security deposit, known as Ta2meen, is held against your account before a bid is accepted. The deposit sits in a licensed escrow account and is never treated as platform revenue.

If your bid does not win, the deposit is returned by the deposits desk after the session closes. If it wins, the deposit is applied against the final invoice.

5. Winning bids, settlement, and the buyer’s premium

Winning bidders are invoiced for the hammer price plus the published buyer’s premium and any applicable duties. Settlement is due within seven calendar days of invoice. Late settlement may result in forfeiture of the deposit and suspension of bidding privileges.

6. Consignment and seller obligations

Consignors warrant that they are the legal owner of the piece, that title is free of encumbrance, and that all representations made to our specialists are accurate. Consignments that cannot be authenticated are returned at the consignor’s expense.

7. Authenticity guarantee

Every lot is subject to the lifetime authenticity guarantee described on the Authenticity page. If provenance is ever disproven, the hammer price and premium are refunded in full. The guarantee is transferable on resale through this platform.

8. Intellectual property and catalogue images

Catalogue photography, condition reports, and editorial content are the intellectual property of The Digital Curator or its consignors. They may not be reproduced commercially without written permission. Personal, non commercial reference is permitted.

9. Prohibited conduct

You may not use the platform to place fraudulent bids, attempt to manipulate outcomes, operate more than one account without disclosure, or circumvent identity verification. Violations result in permanent suspension and, where applicable, referral to authorities.

10. Limitation of liability

To the fullest extent permitted by law, our liability is limited to the value of the transaction in question. We are not liable for indirect or consequential losses, including lost profit or opportunity, save in cases of fraud or wilful misconduct.

11. Dispute resolution and governing law

These terms are governed by the laws of the Dubai International Financial Centre. Disputes are submitted to the DIFC Courts. Proceedings may be conducted in English or Arabic at the party’s election, and both languages are treated as languages of record.

12. Changes to these terms

We may update these terms as the platform and applicable regulations evolve. Material changes are posted here with an updated date and announced through in-platform notifications. Continued use of the platform after notice constitutes acceptance.
